1. Agreement to Terms
By accessing or using OpenSerp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. You must be at least 18 years old to use OpenSerp.
2. Description of Service
OpenSerp is a cloud-based search engine results page (SERP) scraping platform. The Service allows you to upload keyword lists to scrape search engine results, generate keyword intelligence reports, and download structured data.
3. User Responsibilities
You are solely responsible for:
- How you use the data obtained through OpenSerp
- Complying with the terms of service of any search engines you scrape
- Ensuring your use complies with all applicable laws and regulations
- Maintaining the security of your account credentials
OpenSerp provides a tool for data collection. We are not responsible for how you use the scraped data or any consequences arising from such use.
4. Billing & Payments
- OpenSerp uses a pay-as-you-go billing model at $0.000025 per query
- Balance is added by redeeming purchased gift codes
- All purchases and gift code redemptions are non-refundable
- Pricing may change with advance notice; existing balance will be honored at the rate when queried
5. Account Termination
We reserve the right to suspend or terminate your account at our discretion if we determine that you have violated these Terms, engaged in abusive behavior, or used the Service in a manner that threatens the integrity or availability of the platform. Remaining balance on terminated accounts due to abuse is non-refundable.
6. Service Availability
OpenSerp is provided on an "as-is" and "as-available" basis. While we strive to maintain high availability, we do not guarantee uninterrupted or error-free service. We may perform scheduled maintenance with reasonable advance notice when possible.
7. Data & Storage
Your scraped results and cloud files are stored until you choose to delete them. We do not set automatic retention periods. You are responsible for downloading and backing up any data you wish to keep before deleting your files or account.
8. Intellectual Property
The OpenSerp platform, including its design, code, and branding, is owned by OpenSerp. You retain ownership of the data you upload (keyword lists) and the results generated from your tasks.
9. Limitation of Liability
To the maximum extent permitted by law, OpenSerp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Service.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify users of material changes via email or an in-app notification.
